Сервис BMW Motorrad EASY2RIDE является проектом ООО «БМВ Русланд Трейдинг». Все права принадлежат ООО «БМВ Русланд Трейдинг». ООО «ЛУВ» является Сервис-Оператором Программы BMW Motorrad BMW Motorrad EASY2RIDE и действует от имени и с согласия ООО «БМВ Русланд Трейдинг».

Terms and Conditions of Using BMW Motorrad EASY2RIDE

BMW Motorrad BMW Motorrad EASY2RIDE is a project of «BMW Rusland Trading» LLC. All rights belong to the «BMW Rusland Trading» LLC. «SDL» LLC is a Service Operator of the BMW Motorrad BMW Motorrad EASY2RIDE Program and acts on behalf and with the consent of «BMW Rusland Trading» LLC.

1. Общие положения

1. General

1.1. Настоящие Условия (далее — Условия) представляют собой предложение Общества с ограниченной ответственностью «Лаборатория Умного Вождения» (ООО «ЛУВ») (123290, г. Москва, 1-й Магистральный тупик, д. 5 А, этаж 2, ком. 53, офис 203Б) (далее — Сервис-оператор) пользователю сети Интернет (далее — Пользователь) — использовать сервис BMW Motorrad EASY2RIDE (далее — «Сервис») в объеме, который соответствует уровню доступа Пользователя в Сервисе на момент использования программы BMW Motorrad EASY2RIDE для мобильных устройств (далее — Программа).

1.1. These Terms and Conditions (hereinafter the “Terms and Conditions”) are an offer of Smart Driving Lab Limited Liability Company (SDL LLC) (5A 1st Magistralny Tupik, Floor 2, Room 53, Office 203B, Moscow 123290) (hereinafter “Service Operator) for an Internet user (hereinafter the “User”) to use BMW Motorrad EASY2RIDE (hereinafter the “Service”) in the scope corresponding to the User’s access level in the Service at the moment of using BMW Motorrad EASY2RIDE software for mobile devices (hereinafter the “Software”).

1.2. Использование Пользователем Сервиса регулируется настоящими Условиями, а также документами ООО «ЛУВ»:

1.2. Use of the Service by the User is governed by these Terms and Conditions and by the following SDL documents:

• Лицензионным соглашением на использование программы BMW Motorrad EASY2RIDE для мобильных устройств 

• License Agreement for the Use of BMW Motorrad EASY2RIDE Software for Mobile Devices.

• Договором аренды/тест-райда транспортного средства (далее — Договор аренды) в случае регистрации Пользователя в Сервисе, а также дополнительными соглашениями к Договору (далее вместе именуются — «Регулирующие документы»).

• Vehicle Lease/Test Ride Agreement (hereinafter the “Lease Agreement”), if the User is registered in the Service, as well as additional agreements thereto (hereinafter collectively referred to as the “Governing Documents”).

1.3. Начиная использовать Сервис/его отдельные функции, Пользователь считается принявшим настоящие Условия, а также условия Регулирующих документов, а в случае регистрации Пользователя в Сервисе также Договора аренды и/или дополнительных соглашений к Договору в полном объеме, без всяких оговорок и исключений. В случае несогласия Пользователя с какими-либо из положений Условий и/или Регулирующих документов, Лицензионного соглашения на использование программы BMW Motorrad EASY2RIDE, а в случае регистрации Пользователя в Сервисе также Договора аренды и/или дополнительных соглашений к Договору, Пользователь не вправе использовать Сервис.

1.3. When starting using the Service/its individual functions, the User shall be considered to have accepted these Terms and Conditions, as well as the terms and conditions of the Governing Documents, and when the User is registered in the Service, also the terms and conditions of the Lease Agreement and/or additional agreements thereto in full scope, without any reservations and exceptions. If the User does not agree with any provisions of the Terms and Conditions and/or the Governing Documents or the License Agreement for the Use of BMW Motorrad EASY2RIDE Software, and when the User is registered in the Service, with any provisions of the Lease Agreement and/or additional agreements thereto, the User shall not use the Service.

1.4. Сервис-оператор вправе в любое время без уведомления Пользователя изменить положения настоящих Условий, Регулирующих документов и Лицензионного соглашения на использование программы BMW Motorrad EASY2RIDE. Действующая редакция настоящих Условий размещается в сети Интернет по адресу: http://www.bmw-motorrad.ru. Риск неознакомления с новой редакцией Условий, Регулирующих документов и Лицензионного соглашения на использование программы BMW Motorrad EASY2RIDE несет Пользователь, продолжение пользования Сервисом после изменения Условий, Регулирующих документов или Лицензионного соглашения на использование программы BMW Motorrad EASY2RIDE считается согласием с их новой редакцией.

1.4. The Service Operator shall have a right to amend these Terms and Conditions, the Governing Documents, and the License Agreement for the Use of BMW Motorrad EASY2RIDE Software at any time without notifying the User. The current text of these Terms and Conditions is available on the Internet at http://www.bmw-motorrad.ru. The risk of a failure to read the new version of the Terms and Conditions, the Governing Documents, and the License Agreement for the Use of BMW Motorrad EASY2RIDE Software shall be borne by the User, and further use of the Service after the Terms and Conditions, the Governing Documents, or the License Agreement for the Use of BMW Motorrad EASY2RIDE Software is amended shall be recognized as acceptance of their new revision.

1.5. В случае если Сервис-оператором были внесены какие-либо изменения в настоящие Условия, в порядке, предусмотренном п. 1.4. настоящих Условий, с которыми Пользователь не согласен, он обязан прекратить использование Сервиса.

1.5. If the Service Operator makes any amendments to these Terms and Conditions in the manner set out in Clause 1.4 hereof and the User does not agree with such amendments, the User shall stop using the Service.

1.6. Сервис предлагается Пользователю в объеме, который соответствует уровню доступа Пользователя в Сервисе на момент использования Программы. Все существующие на данный момент функции Сервиса, а также любое изменение их и/или добавление новых является предметом настоящих Условий.

1.6. The Service is offered to the User in the scope corresponding to the User’s access level in the Service at the time of using the Software. All Service functions existing at the present time, as well as any changes thereto and/or new functions, shall be the subject matter of these Terms and Conditions.

1.7. Сервис-оператор вправе в любое время без уведомления Пользователя изменить функциональные возможности Сервиса.

1.7. The Service Operator shall have a right to change the Service features at any time without notifying the User.

1.8. Сервис предоставляется Пользователю для личного некоммерческого использования в объеме, который соответствует уровню доступа Пользователя в Сервисе на момент использования Программы

1.8. The Service is provided to the User for personal non‑commercial use in the scope corresponding to the User’s access level in the Service at the time of using the Software.

2. Регистрация в Сервисе. Предоставление информации

2. Registration in the Service. Provision of Information

2.1. В целях предоставления доступа к Сервису Пользователь должен пройти регистрацию в Сервисе с указанием своих данных.

2.1. To access the Service, the User shall complete registration in the Service and provide their details.

2.2. Передача или раскрытие Пользователем своих регистрационных данных третьим лицам запрещена. В случае наличия подозрений, что данными завладело или пользуется третье лицо, Пользователь обязан незамедлительно сообщить об этом службе поддержки Сервиса support.easy2ride@smartdriving.io. При этом все действия в рамках или с использованием Сервиса под учетной записью Пользователя считаются произведенными самим Пользователем, за исключением случаев, когда Пользователь, в порядке, предусмотренном настоящим пунктом, уведомил службу поддержки Сервиса о несанкционированном доступе к Сервису с использованием учетной записи Пользователя и/или о любом нарушении (подозрениях о нарушении) конфиденциальности своих средств доступа к учетной записи.

2.2. The User may not transfer or disclose the User’s registration data to third parties. If the User suspects that any third party has obtained or is using its details, the User shall inform the Service Help Desk support.easy2ride@smartdriving.io about that without delay. In this case, all actions taken in or using the Service with the User’s account shall be deemed taken by the User, except when the User has notified the Service Help Desk about the unauthorized access to the Service with the User’s account and/or about any breach (suspected breach) of confidentiality of their account access details in the way stipulated herein.

2.3. В целях предоставления доступа к Сервису Пользователь указывает свой номер мобильного телефона. На указанный номер мобильного телефона направляется код, который Пользователю необходимо ввести в целях верификации Пользователя.

2.3. The User shall provide their mobile telephone number to access the Service. The User will receive the code to this mobile telephone number and shall enter it for the purpose of User verification.

2.4. После введения кода, присланного на номер мобильного телефона Пользователя, Пользователь предоставляет следующие документы и информацию о себе, включая свои персональные данные:

2.4. After entering the code sent to the User’s mobile telephone number, the User shall submit the following documents and information about themselves, including their personal data:

• фотографию водительского удостоверения (обе стороны)

• Photo of the driver’s license (both sides).

• фотографию паспорта (разворот с фотографией и данными о регистрации)

• Photo of the passport (the two-page spread with the photo and registration details).

• фотографию Пользователя.

• The User’s photo.

2.5. Необходимая информация и документы предоставляются Пользователем в порядке и формате, предусмотренным Программой. Состав и комплектность необходимой информации и документов могут быть изменены по решению Сервиса. Список необходимой информации и документов, указанный в п. 2.4. выше, может отличаться от необходимой информации и документов, запрашиваемых в Программе. Актуальный список необходимой информации и документов содержится в Программе.

2.5. The User shall submit the necessary information and documents in the manner and format provided for by the Software. The scope and content of the necessary information and documents may be changed upon the decision of the Service. The list of the necessary information and documents specified in Clause 2.4 above may differ from the necessary information and documents requested in the Software. The up-to-date list of the necessary information and documents can be found in the Software.

2.6. Указанные в п.2.4 документы и информация отправляются на проверку, по результатам которой Пользователю направляется ответ с информацией о предоставлении доступа к полному функционалу Сервиса (регистрация в Сервисе) или о невозможности предоставления доступа к полному функционалу Сервиса (отказе в регистрации в Сервисе).

2.6. The documents and information specified in Clause 2.4 shall be sent for verification, after which the User will receive a reply with the information on granting access to the complete functionality of the Service (registration in the Service) or on denial of access to the complete functionality of the Service (denial of registration in the Service).

2.7. Пользователь дает Сервис-оператору и его партнерам согласие на обработку персональной информации (включая персональные данные) Пользователя, на передачу Сервис-оператором персональной информации Пользователя партнерам Сервис-оператора, а также на обработку персональной информации для целей оказания Пользователю услуг в рамках Сервиса, а также предоставлению Пользователю ТС Арендодателем, а также иных услуг, предусмотренных Договором аренды и/или дополнительными соглашениями к Договору.

2.7. The User will give the Service Operator and its partners consent to the processing of the User’s personal information (including personal data), to the transfer of the User’s personal information by the Service Operator to its partners, and to the processing of personal information for the purpose of rendering services to the User within the frames of the Service, as well as to the provision of a vehicle by the Lessor to the User, and other services provided for by the Lease Agreement and/or additional agreements thereto.

Пользователь настоящим дает согласие на запись телефонных разговоров со службой поддержки и иными представителями Сервис-оператора.

2.7.1. Пользователь выражает свое согласие с Условиями и способами обработки персональных данных BMW Group в России, с которыми можно озакомится по адресу: https://www.bmw.ru/ru/ssl/storage-personal-data.html. Пользователь выражает свое согласие на получение информации от BMW Group в России в том числе рекламной информации товаров и услуг по сетям электросвязи (в частности, но не ограничиваясь: телефонной, смс, по адресу электронной почты) в соответствии с п. 1 ст. 18 Федерального закона от 13.03.2006 N 38-ФЗ "О рекламе".

The User hereby gives consent to the recording of phone conversations with the Help Desk and other representatives of the Service Operator.

2.7.1. The User expresses his consent to the Terms and methods of processing personal data of the BMW Group Russia, which can be viewed at: https://www.bmw.ru/ru/ssl/storage-personal-data.html. The User expresses his consent to receive information from the BMW Group Russia, including advertising information on goods and services on telecommunication networks (in particular, but not limited to: telephone, SMS, email address) in accordance with paragraph 1 of Art. Eighteen Federal Law of 13.03.2006 N 38-ФЗ "On Advertising".

2.8. Пользователь дает согласие Сервис-оператору и его партнерам на проверку любых сведений, предоставленных Пользователем при регистрации в Сервисе и заполнении Пользователем заявки через доступные базы данных, а также на получение информации о кредитной истории Пользователя в бюро кредитных историй и центральном каталоге кредитных историй в объеме и порядке, предусмотренными Федеральным законом РФ № 218-ФЗ «О кредитных историях» с целью проверки сведений, предоставленных Пользователем, и оценки возможности предоставления Пользователю Сервиса.

2.8. The User hereby gives to consent the Service Operator and its partners verifying any data provided by the User during the registration in the Service and filling out of an application form via available databases, as well as to the receipt of information about the User’s credit history in the credit history bureau and in the central catalog of credit histories in the scope and in the manner provided for by the Federal Law No. 218-FZ “On Credit Histories”, for the purpose of verifying data provided by the User and evaluating the possibility of rendering the Service to the User.

2.9. Согласие на обработку данных Пользователя действительно в течение срока, необходимого для предоставления Сервиса.

2.9. Consent to the processing of the User’s data shall be valid during the period required to provide the Service.

2.10. Сервис-оператор оставляет за собой право на свое усмотрение отказать Пользователю в доступе к Сервису или ограничить доступ Пользователя к Сервису (или к определенным функциям Сервиса, если это возможно технологически) с использованием его учетной записи или полностью заблокировать учетную запись Пользователя, в том числе, но не ограничиваясь, при обнаружении неполноты предоставленных Пользователем сведений или недостоверных сведений, предоставленных Пользователем, неоднократном нарушении настоящих Условий, условий Договора аренды и/или дополнительных соглашений к Договору, либо применить к Пользователю иные меры с целью соблюдения требований законодательства или прав и законных интересов третьих лиц.

2.10. The Service Operator reserves the right to deny the User access to the Service at its sole discretion or to restrict the User’s access to the Service (or to certain functions of the Service, when it is technologically possible) using the User’s account, or to fully block the User’s account, inter alia, upon the discovery of any incomplete or false data provided by the User, upon a repeated violation of these Terms and Conditions, the terms and conditions of the Lease Agreement and/or additional agreements thereto, or to apply other measures to the User in order to comply with the legislative requirements or to the observe rights and lawful interests of third parties.

3. Использование Сервиса. Отдельные функции Сервиса

3. Use of the Service. Individual Service Functions

3.1. Сервис предлагает Пользователю бесплатную возможность ознакомиться с информацией о Сервисе, включая данные об условиях регистрации Пользователя в Сервисе, правилах и условиях использования Сервиса, а также возможность использовать Сервис в объеме, который соответствует уровню доступа Пользователя в Сервисе на момент использования Программы, а также совершать иные действия, предусмотренные Условиями использования Сервиса при наличии у Пользователя соответствующего уровня доступа к таким услугам. Зарегистрированному Пользователю предоставляется возможность забронировать транспортное средство (далее — ТС) через Программу с опцией подтверждения, отмены или продления такой брони на условиях Договора аренды и/или дополнительных соглашений к Договору, если Пользователь соглашается с условиями Договора аренды и/или дополнительных соглашений к Договору.

3.1. The Service offers the User a free possibility to study information about the Service, including data on the terms and conditions of User registration in the Service, rules and conditions of using the Service, as well as a possibility to use the Service in the scope corresponding to the User’s access level in the Service at the time of using the Software, as well as to take other actions provided for by the Terms and Conditions of Using the Service, if the User has the respective level of access to such services. A registered User will be able to book a vehicle via the Software with an option of reservation confirmation, cancellation, or extension on the terms and conditions of the Lease Agreement and/or additional agreements thereto, provided that the User accepts the terms and conditions of the Lease Agreement and/or additional agreements thereto.

3.2. Пользователь сверяется с наличием в ТС документов (свидетельства о регистрации ТС, страхового полиса) и иных объектов в соответствии с листом проверки, который доступен в Программе. При отсутствии любого из указанных документов или объектов из листа проверки Пользователь сообщает об этом Сервису через Программу и/или Арендодателю.

3.2. The User shall check that documents (vehicle registration certificate, insurance policy) and other items are available in the Vehicle according to the checklist in the Software. Should any document or item from the checklist be missing, the User shall inform the Service about that via the Software, and/or inform the Lessor.

3.3. При завершении аренды ТС Пользователь нажимает в Программе кнопку, означающую завершение поездки (аренды) и подтверждает завершение аренды ТС.

3.3. Upon the expiry of the Vehicle rental period, the User shall press the button in the Software to finish the trip (lease) and confirm the end of vehicle lease.

3.4. Для получения подробной информации о Сервисе Пользователь может либо обратиться в службу поддержки Сервиса, либо, используя функциональные возможности Сервиса, предоставить свои контактные данные, по которым служба поддержки Сервиса сможет самостоятельно связаться с Пользователем и предоставить ему такую информацию.

3.4. To receive detailed information about the Service, the User may either contact the Service Help Desk or provide their contact details using the Service for the Service Help Desk to contact the User and provide them with such information.

3.5. В зависимости от региона нахождения Пользователя все или некоторые функции Сервиса могут быть недоступны или ограничены. Функции считаются недоступными (ограниченными) для Пользователя из определенного региона, если такой Пользователь не может ими воспользоваться в явном виде. Применение любых технических и программных методов обхода данных ограничений запрещено. Положения настоящих Условий, регулирующие недоступные (ограниченные) для Пользователя функции Сервиса, не применяются до тех пор, пока Пользователю такие функции не станут доступны в явном виде. Информация о доступности функций Сервиса в определенном регионе предоставляется Пользователю по его запросу.

3.5. Depending on the User’s region, all or some of Service functions may be unavailable or limited. The functions shall be deemed unavailable (limited) for the User from a certain region if such User cannot use them explicitly. Use of any technical and program methods to bypass these restrictions is prohibited. The provisions of these Terms and Conditions governing the Service functions not available (limited) for the User shall not apply until such function become explicitly available for the User. Information on the availability of Service functions in a certain region is provided to the User on request.

3.6. Используя Сервис, Пользователь дает свое согласие на получение сообщений рекламного и информационного характера. Пользователь вправе отказаться от получения сообщений рекламного характера путем использования соответствующего функционала Сервиса или следуя инструкциям, указанным в полученном сообщении рекламного характера.

3.6. By using the Service, the User agrees to receive promotional and information messages. The User shall have a right to refuse receiving promotional messages by using the relevant Service function or by following the guidelines specified in such promotional message.

3.7. В зависимости от региона Пользователя при отсутствии у Пользователя доступа к сети Интернет он может обратиться в службу поддержки Сервиса за помощью в использовании Сервиса. В этом случае специалист службы поддержки Сервиса действует от лица и по поручению Пользователя, права и обязанности по настоящим Условиям возникают непосредственно у Пользователя. О доступности такой возможности Сервис информирует на сайте http://www.bmw-motorrad.ru с указанием соответствующего номера телефона службы поддержки.

3.7. Depending on the User’s region, if the User does not have Internet access, they may contact the Service Help Desk for help in using the Service. In this case, the specialist of the Service Help Desk will act on behalf and by order of the User, and the User will acquire the rights and obligations hereunder. The Service shall inform of the availability of such feature on the website at http://www.bmw-motorrad.ru and provide the Help Desk phone number.

3.8. Используя Сервис, Пользователь подтверждает, что он предупрежден и согласен с тем, что Сервис предоставляется Пользователю в объеме, который соответствует уровню доступа Пользователя в Сервисе на момент использования Программы. Сервис-оператор вправе вносить любые изменения в структуру и алгоритмы работы Сервиса, приостанавливать его работоспособность или работоспособность его функций, изменять или прекращать выполнение функций Сервиса без заблаговременного предупреждения Пользователя и без выражения последним согласия на это.

3.8. By using the Service, the User confirms that they have been informed and agree that the Service is provided to the User in the scope corresponding to the User’s access level in the Service at the time of using the Software. The Service Operator may change the Service structure and performance algorithms, suspend its operation capacity or operation capacity of its functions, alter, or stop the performance of Service functions without giving a prior notice thereof to the User and without the latter’s consent thereto.

4. Платежные данные

4. Payment Details

4.1. Сервис предоставляется Пользователю на безвозмездной основе. Услуги по аренде ТС предоставляются в соответствии с условиями Договора аренды и/или дополнительных соглашений к Договору. Актуальная информация о тарифах по Договору аренды и/или дополнительных соглашений к Договору доводится до сведения Пользователя в том числе через Программу.

4.1. The Service is provided to the User free of charge. Vehicle rental services shall be provided in accordance with the terms and conditions of the Lease Agreement and/or additional agreements thereto. The current information on the tariffs under the Lease Agreement and/or additional agreements thereto shall be communicated to the User, inter alia, via the Software.

4.2. В целях подключения Пользователя к Сервису и дальнейшей возможности оплаты по Договору аренды и/или дополнительных соглашений к Договору Пользователь привязывает свою банковскую карту к Программе (п. 4.3 настоящих Условий).

4.2. For the purpose of connecting the User to the Service and enabling further payments under the Lease Agreement and/or additional agreements thereto, the User shall add its bank card to the Service (Clause 4.3 hereof).

При безналичной оплате по усмотрению Сервис‑оператор возможно проведение как одной транзакции на полную стоимость услуги, так и нескольких транзакций на отдельные части стоимости услуги. При этом безналичная оплата может быть произведена любым из указанных способов до поездки, либо по ее завершении.

In the case of non-cash payment, the Service Operator may allow one transaction for the full value of the service or several transactions for individual portions of the service value at its own discretion. In this case, non-cash payment may be effected in either of the above ways before or after the trip.

Сервис-оператор не гарантирует отсутствие ошибок и сбоев в отношении предоставления возможности безналичной оплаты.

The Service Operator does not guarantee the absence of errors and failures with respect to non-cash payments.

4.3. Привязанная банковская карта может указываться Пользователем в настройках Программы, при этом Пользователь указывает следующие данные:

4.3. The bank card may be indicated by the User in the Software settings. In this case, the User shall provide the following data:

• Номер банковской карты

• Bank card number.

• Имя, фамилия держателя карты

• Card holder’s name.

• Действительна до

• Expiry date.

• Защитный код.

• CVV.

Если данные банковской карты верны, действительны и использование данной карты в рамках Сервиса технически возможно, указанная банковская карта приобретает статус Привязанной и может быть использована для безналичной оплаты (п. 4.2 настоящих Условий). Все Привязанные карты отображаются в настройках Программы; для удобства Пользователя в отношении Привязанной карты отображаются 4 последние цифры номера Привязанной карты, что не противоречит п. 4.4 настоящих Условий.

If the bank card data are correct and valid, and if it is technically possible to use this card in the Service, such bank card will become Verified and may be used for non‑cash payments (Clause 4.2 hereof). All Verified Cards are shown in the Software settings. For the User’s convenience, only the last four digits of the Verified Card number will be displayed, which is not in conflict with Clause 4.4 hereof.

4.4. При указании своих данных согласно п. 4.3 настоящих Условий и дальнейшем использовании Привязанной карты Пользователь подтверждает и гарантирует указание им достоверной и полной информации о действительной банковской карте, выданной на его имя; соблюдение им правил международных платежных систем и требований банка-эмитента, выпустившего Привязанную карту, в том числе в отношении порядка проведения безналичных расчетов.

4.4. When providing their details as per Clause 4.3 hereof and in further use of the Verified Card, the User acknowledges and guarantees that they have provided accurate and full information about a valid bank card issued in their name, compliance with the rules of the international payment systems and the requirements of the bank that issued the Verified Card, inter alia, with respect to non-cash payments.

4.5. Сервис-оператор оставляет за собой право в любой момент потребовать от Пользователя подтверждения данных, указанных им в рамках Сервиса, в том числе данных Привязанной карты, и запросить в связи с этим подтверждение личности Пользователя путем как личного присутствия в офисе Сервиса, так и предоставление подтверждающих документов (в частности, документов, удостоверяющих личность), непредоставление которых, по усмотрению Сервис‑оператора, может быть приравнено к предоставлению недостоверной информации и повлечь последствия, предусмотренные п. 2.10 настоящих Условий.

4.5. The Service Operator reserves the right to demand at any time that the User confirm their data provided in the Service, including Verified Card data, and request the verification of the User’s identity by way of the User’s personal presence in the office of the Service or by way of provision of confirmation documents (in particular, identification documents), a failure to provide which, in the opinion of the Service Operator, may be treated as provision of false information and entail the consequences set out in Clause 2.10 hereof.
